The purpose of the Privacy Policy is to familiarize users with the purposes and basis of personal data processing by the controller.

Protection of personal data

The security of users' personal data is our priority. We pay a lot of attention to personal data and their protection. When processing the personal data of the individual and handling it, the controller will act in accordance with the requirements of the current legislation in the field of personal data protection (ZVOP-1, Ur. l. 94/2007).

In order to secure personal data, the controller will use organizational, technical and other appropriate procedures and measures to prevent unauthorized destruction of data, its change or loss, and unauthorized processing.

In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals in the processing of personal data and on the free flow of such data and on the repeal of Directive 95/46/EC (General Data Protection Regulation (hereinafter General Data Protection Regulation) personal data is any information relating to an identified or identifiable individual. An identifiable individual is one who can be identified directly or indirectly, in particular by reference to an identifier such as name, identification number, location data, online identifier, or by specifying one or more factors that characterize the physical, physiological, genetic, mental, economic, cultural or social identity of that individual.

Categories of personal data and definition of the term processing

We collect different information about you, depending on the nature of our business relationship with you and the legal basis we use to process the data.

If you receive our newsletter, we collect: email address.

If you have filled out the narrator application form on the website www.audibook.si, we collect: first name, last name, email address, phone number, gender.

If you are a registered user of the Audibook application, we collect: first name, last name, email address, means of payment, data generated by using the service.

If you participate in promotional campaigns with prizes, we collect: email address, first name, last name, address. Prize winners must also provide the provider with a tax number if the prize is worth more than EUR 42, and if it is a monetary prize, also the bank account number.

Processing of personal data means any operation or series of operations carried out in connection with the provision of services and linked to the personal data of an individual, so that they are automatically processed or are part of the collection of personal data during manual processing or are intended to be included in the collection of personal data, in particular collection, retrieval, entry, editing, storage, adaptation or modification, retrieval, access, use, disclosure by transmission, communication, dissemination or other making available, classification or linking, blocking, anonymisation, deletion or destruction. Processing can be manual or automated.

Basis for the processing of personal data

We may process your personal data for the purposes of implementing the contract we have concluded with you; when we have to comply with a legal obligation (for example, under legislation governing criminal liability for public incitement to hatred, violence or intolerance); where necessary for our legitimate interests (or the legitimate interests of a third party) and your interests (for example to detect and prevent fraud or ensure network and information technology security), unless your fundamental rights override these interests; when it is necessary to protect your important interests (or the important interests of others); or when this is necessary for the public interest or for official purposes.

We process your personal data for various technical, administrative and operational reasons, for example to ensure that the content is presented to you in the most effective way according to your computer; to improve our website, including its usability; to manage our websites; for internal purposes, including troubleshooting, data analysis, testing, research, statistical and research purposes; for marketing, including targeted marketing to show you content that may be of interest to you; and as part of our efforts to keep our websites safe and secure.

In some cases, we will only process your personal data with your consent. In such cases, we will separately ask for your express consent when you provide us with your personal data. The personal data of the individual will be forwarded to third parties only when this is necessary in the context of fulfilling the rights and obligations from the concluded sales contract, based on the legitimate interest of the controller, or if the individual expressly agrees to this in advance.

The controller of personal data is obliged to provide the individual with access to the personal data it processes about him at his request.

Also, at the request of the data subject, the controller of personal data must correct, limit the processing or delete personal data that the individual proves to be incomplete, inaccurate or out of date, or that they were collected or processed illegally.

The controller of personal data must, upon his request, provide the individual with confirmation as to whether personal data is being processed in relation to him and, when this is the case, access to personal data (enable inspection or reproduction of this personal data) and the following information:

The controller of personal data must, at the request of the individual to whom the personal data relates, correct inaccurate personal data relating to him or delete personal data that the individual proves is no longer necessary for the purposes for which it was collected or otherwise processed, there is no legal basis for their processing, the individual objects to their processing and there are no overriding legal reasons for their processing, they were collected or processed illegally, they must be deleted to fulfill a legal obligation applicable to the controller, or they were collected in connection with the offer of information society services from a minor.

The individual to whom the personal data relates has the right, on the basis of reasons related to his special situation, to object at any time to the processing of personal data concerning him, which is based on point (e) or (f) of Article 6(1) of the General Data Protection Regulation (GDPR), including the creation of profiles based on these provisions. The controller complies with the objection and stops processing personal data, unless he proves urgent legitimate reasons for processing that override the interests, rights and freedoms of the individual to whom the personal data refer, or for the assertion, implementation or defense of legal claims.

The right to data portability

The data subject has the right to receive the personal data relating to him, which he has provided to the controller, in a structured, commonly used and machine-readable form, and the right to transmit this data to another controller without being hindered by the controller to whom the personal data was provided, if the processing is based on consent or a contract and the processing is carried out by automated means.
